Felony Sex Case - No Jail Sentence & Bail Cut in Half
Our client was a 40 year-old woman who was accused of having sexual intercourse with two underage teen boys. She was arrested on her way to work early in the morning. The prosecutor charged our client with three felony counts of “unlawful sexual intercourse with a minor” (Penal Code Section 261.5(c)). The prosecutor also contemplated charges for “oral copulation with a minor,” in addition to other charges. If convicted of all the potential charges, our client could have faced upwards of 10 years in prison.
Our client's bail was set $100,000 over the regular “bail schedule” amount, based on alleged aggravating circumstances of the offenses. At a bail hearing early in the case, we convinced the judge to cut her bail in half. This allowed our client to get out of jail while her case was pending.
After an intensive investigation and multiple rounds of negotiation with the District Attorney, we achieved a great outcome for our client. We convinced the DA to drop two of the felony counts. We also convinced the DA to not file multiple additional felony counts. Based on our negotiations with the prosecutor, our client was ultimately sentenced to two years of probation with NO jail time.
